Men hvordan er reglerne, omkring sygdom under ferie?<\/p>\n<p>Er en medarbejder syg p\u00e5 tidspunktet for feriens begyndelse, er der tale om en feriehindring. Det medf\u00f8rer at ferien ikke p\u00e5begyndes, og medarbejderen har ret til at holde ferien p\u00e5 et andet tidspunkt. P\u00e5 den m\u00e5de anvendes en given arbejdskraft alene, n\u00e5r virksomheden har behov for det.<\/p><p>Men hvorvidt man som skatteyder bliver betragtet som freelance, selvst\u00e6ndig konsulent eller l\u00f8nmodtager, har intet med titel at g\u00f8re. Dvs. at medarbejderen selv b\u00e6rer risikoen for de f\u00f8rste 5 sygedage under ferie i hvert ferie\u00e5r. Hvis medarbejderen f.eks. f\u00f8rst sygemelder sig p\u00e5 3. sygedag, s\u00e5 t\u00e6ller de f\u00f8rste 2 sygedage som udgangspunkt ikke med \u2013 hverken som karensperiode eller som erstatningsferie, hvis karensperioden er \u201dopbrugt\u201d under en tidligere ferie. Medarbejderen skal selv betale l\u00e6geerkl\u00e6ringen, og er der tale om sygdom over flere sygdomsperioder og i flere ferieperioder, skal der ske l\u00e6gelig dokumentation for hver enkel sygdomsperiode. L\u00e6geerkl\u00e6ringen kan udstedes som en friattest eller anden betryggende dokumentation, f.eks. journaludskrift fra et hospital. Arbejdsgiveren kan v\u00e6lge at give afkald p\u00e5 l\u00e6geerkl\u00e6ringen.<\/p><\/div>\n\t\t\t\t<\/div>\n\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t<div class=\"elementor-element elementor-element-3f20ba6 e-flex e-con-boxed e-con e-parent\" data-id=\"3f20ba6\" data-element_type=\"container\" data-e-type=\"container\">\n\t\t\t\t\t<div class=\"e-con-inner\">\n\t\t\t\t<div class=\"elementor-element elementor-element-f3d8702 elementor-widget elementor-widget-heading\" data-id=\"f3d8702\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t<h2 class=\"elementor-heading-title elementor-size-default\">Opg\u00f8relse af karensdage ved sygdom over ferie<\/h2>\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-602abcd elementor-widget elementor-widget-text-editor\" data-id=\"602abcd\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p><em>Eksempel: <\/em>En medarbejder bruger f\u00f8rst 15 feriedage til en lang vinterferie, hvor medarbejderen bliver syg i 3 dage. Medarbejderen sygemelder sig og dokumenterer sygdommen, som han skal. S\u00e5 holder han 2 ugers sommerferie, hvor han bliver syg i 5 dage. De tre dages sygdom under vinterferien t\u00e6ller med i karensperioden, s\u00e5ledes at medarbejderen har krav p\u00e5 erstatningsferie fra og med 3. sygedag under sommerferien. I alt har medarbejderen alts\u00e5 krav p\u00e5 3 erstatnings feriedage.<\/p><p>Hvis medarbejderen ikke havde ringet til arbejdsgiver og meldt sygdom under ferie, ville de 3 dage ikke t\u00e6lle med, og alle 5 dage under sommerferien ville v\u00e6re karensdage.<\/p><p><strong>Hvor lang er karensperioden ved f\u00e6rre end 25 optjente feriedage?<br \/><\/strong>Hvis medarbejderen ikke har optjent sine 25 feriedage, er der ret til erstatningsferiedage efter et forholdsm\u00e6ssigt f\u00e6rre antal sygedage. Karensperioden bliver alts\u00e5 kortere. Har medarbejderen f. eks. kun optjent 20 feriedage i optjenings\u00e5ret, indtr\u00e6der erstatningsferien efter den 4. sygedag (20 x 1\/5). Det grundlag der beregnes ud fra, hvor mange dage en medarbejder ikke f\u00e5r erstatningsferie for, er alts\u00e5 antallet af optjente feriedage ganget med 1\/5.
